1. Acceptance of terms

By downloading, installing, or using the Althea iOS application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the App.

These Terms constitute a legally binding agreement between you and the developer of Althea. Use of the App is also subject to Apple's App Store Terms and Conditions, which are incorporated herein by reference.

2. License to use the App

Subject to your compliance with these Terms and your maintenance of an active subscription (where applicable), we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.

Althea is a personal health tracking tool. It is not a medical device, does not provide medical diagnoses, and does not give medical advice. All content, data, and features are for informational and organisational purposes only.

The pharmacokinetic (PK) curves and active-level estimates shown in the App are based on published population-average drug models. Individual responses to GLP-1 medications vary considerably. These estimates are intended as general guidance only and should never be used to adjust your dosing schedule without first consulting your prescribing healthcare provider.

Always follow the instructions of your licensed healthcare provider regarding your GLP-1 medication, dosing, titration schedule, and any symptoms you experience. Never delay seeking professional medical advice based on anything you see in the App.

4. Subscriptions & billing

Plans

Althea offers two auto-renewing subscription plans:

Billing

All billing is handled by Apple through the App Store. Your payment will be charged to your Apple ID account. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Free trial

The 7-day free trial is available only to new subscribers who have not previously activated a trial for Althea under the same Apple ID. We reserve the right to determine trial eligibility.

Cancellation

You can cancel your subscription at any time through:

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date. We do not offer refunds for partial billing periods, except where required by applicable law.

Price changes

We may change subscription prices at any time. If we do, Apple will notify you in advance, and your subscription will renew at the new price only if you accept the change.

5. Your content & data

All health data, notes, and information you enter into Althea ("Your Content") remains yours. You retain full ownership of and responsibility for Your Content.

Because Your Content is stored on your device and in your private iCloud account (not on our servers), we have no access to it. You are solely responsible for maintaining the accuracy, completeness, and security of Your Content.

You represent and warrant that Your Content does not violate any applicable law or infringe any third-party rights.

The App, including its design, code, content, branding, UI, and all associated materials, is owned by the developer of Althea and is protected by applicable intellectual property laws. The "Althea" name, leaf logo, and associated trademarks are proprietary to us.

Nothing in these Terms grants you any right, title, or interest in the App beyond the limited licence described in Section 2.

8. Third-party services

The App integrates with certain third-party services, including Apple HealthKit, Apple CloudKit, Open Food Facts, and Apple StoreKit. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or reliability of third-party services.

9. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy of any health estimates, PK curves, or nutritional data displayed in the App.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or death, arising from or in connection with:

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid for your current subscription period, or USD $10.00, whichever is greater.

You acknowledge that GLP-1 medications are prescription treatments that carry medical risks. The App does not mitigate those risks. Health and dosing decisions must be made in consultation with a qualified healthcare provider, not on the basis of App-generated data.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Governing law

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at the address in Section 14. If unresolved, disputes may be brought before the competent courts of the applicable jurisdiction.

Nothing in these Terms affects any non-waivable statutory rights you may have under the laws of your country of residence.

13. Changes to these terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. For material changes, we will notify you via an in-app notice or through the App Store update notes. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

If you do not agree to a revised version of the Terms, you should stop using the App and, if applicable, cancel your subscription before the changes take effect.
